The terms that apply when you purchase commodities from Hamoodley Mining and Oil Company.
The following terms apply to purchases of commodities, including gold, coal, diamonds, and related products, from Hamoodley Mining and Oil Company ("Hamoodley", "we", "us"). By placing an order you accept these terms.
These terms govern all purchases of commodities from our trading desk, whether through this website or by agreement with our wholesale desk. They apply alongside any order confirmation, pro-forma invoice, or commodity purchase agreement.
Quotations shown on this website are indicative and may change with market conditions. A binding order is formed when we confirm acceptance of your order and, where applicable, payment is received. Orders are subject to availability and final confirmation by our desk.
Prices are quoted in South African Rand (ZAR) and may be settled in ZAR or in Bitcoin (BTC) at the applicable rate. The amount due is the amount quoted at the time your order is confirmed. Prices exclude delivery unless stated otherwise.
A tax invoice will be issued for your records. Please consult your tax adviser regarding deductibility. We do not provide tax advice.
Title in commodities passes to you on payment in full and delivery of the product or, for in-transit goods, as specified in the order confirmation. Risk transfers at the point of delivery or handover as agreed. Delivery times are estimates and not guaranteed.
Commodities are supplied with the documentation described at the time of order. As examples: gold bullion is sold with the assay or certification stated in the listing, and natural diamonds are accompanied by a GIA Diamond Grading Report where stated, with the individual report number verifiable through GIA Report Check (www.gia.edu/report-check). It is your responsibility to verify certification before accepting delivery.
Where transit insurance is selected, it covers the value of the consignment during shipment. We are not responsible for loss or damage during transit where no insurance was selected.
Claims relating to damaged, missing, or incorrect goods must be raised in writing within 7 days of receipt. Returns are not accepted for precious metals, coins, or certified stones unless the product is materially different from its description.
We are not liable for delays or failure to perform caused by events beyond our reasonable control, including natural disasters, regulatory action, market disruption, supply failure, or network interruption.
To the fullest extent permitted by law, our liability in connection with any order is limited to the amount paid for the products concerned. We are not liable for indirect, consequential, or loss of profit damages.
These terms are governed by the laws of the Republic of South Africa, and any dispute is subject to the jurisdiction of the South African courts.
